§ 5-64. Liability insurance required.

  • (a)

    No non-emergency medical transportation carrier certificate shall be issued under this article, nor shall such certificate be valid after issuance, nor shall any non-emergency medical transportation carrier vehicle be operated in the city unless there is at all times in force and effect insurance coverage, issued by an insurance company licensed to business in the state, for each and every vehicle owned and/or operated by or for the holder of a certificate, providing for bodily injury and property damage coverage, in the minimum amounts of $1,000,000.00 for each medical accident and $3,000,000.00 annual aggregate:

    (1)

    For injury to or death of individuals in accidents resulting from any cause for which the owner of said vehicle would be liable on account of liability imposed on him by law, regardless of whether the vehicle was being driven by the owner or his agent, and

    (2)

    For the loss of or damage to the property of another, including personal property, under like circumstances, in such sums and under such terms as may be required in regulations promulgated by the city manager or his designee.

    (b)

    Said insurance policies shall be submitted to the city manager or his designee, for approval prior to the issuance of each certificate. Satisfactory evidence that such insurance is at all times in force and effect shall be furnished to the city manager or his designee, in such form as he may specify, by all certificate holders that are required to provide insurance under the provisions of this article.

    (c)

    A certificate holder shall give the city manager or his designee, not less than 30 days' written notice before any cancellation or termination thereof earlier than its expiration date of any of the insurance required by this article and the cancellation or other termination of any such insurance policy shall automatically revoke and terminate the certificate issued covered by such policy, unless another insurance policy complying with the provisions of this section shall be provided and be in effect at the time of such cancellation or termination.
